NYLPI Celebrates Enjoinment of the “Death to Asylum” Rule

NYLPI celebrates the enjoinment of the “Procedures for Asylum and Withholding of Removal; Credible Fear and Reasonable Fear Review” rule, more commonly referred to as the “Death to Asylum” Rule. On January 8, 2021, the U.S. District Court for the Northern District of California preliminarily enjoined the government from implementing, enforcing, or applying the final rule issued by the Department of Homeland Security (DHS) and Department of Justice (DOJ) on December 11, 2020.
NYLPI submitted comments to the DOJ and DHS opposing the Trump Administration’s proposed changes to asylum procedures. The comment included statutory arguments as well as personal stories from NYLPI’s work with asylum seekers.
We call on the Biden Administration to accept the court’s ruling and to withdraw the rule in its entirety.
